1. RECOGNITION

The tenant expressly recognizes the general rental conditions as an integral part of the rental contract, in particular liability for damage caused by the tenant to the rental property or third-party property and is concerned that he is properly informed about the handling of the rental property. Animals are allowed in consultation with the landlord on site.

2. START AND END OF RENTAL

All rentals begin at the landlord's domicile and end as soon as the rental object is delivered to the landlord's domicile on time. If the start of the rental period is prevented or if the rental period is unexpectedly extended, the landlord must be informed immediately. If the rented object is not returned after the agreed time, the renter must pay the corresponding price for each hour started.

3. ORDER CHANGE/CANCELATION BY CUSTOMER
Any changes to the booked activity can be reported to the organizer verbally or in writing up to 7 days before the start of the activity without additional costs. In the case of illness-related postponements, a doctor's certificate must be presented. A withdrawal from the contract by the customer must be made in writing. In this case, the customer is obliged to pay the following cancellation fees: - after booking 15%
                               - 90 to 31 days before the start of the activity 30%
                               - 30 to 7 days before the start of the activity 50%
                               - from 6 days before the start of the activity or no-show 100%

If the customer is late for the activity, the duration of the activity will be reduced accordingly. In case of no-show, the latter pays 100% of the price. Additional costs incurred due to postponement, late arrival or non-appearance are at his expense.

4. AUTHORIZATION TO RUN THE RENTAL PROPERTY

Only the person who signed the rental agreement is authorized to maneuver the boat. The tenant is fully liable for any traffic violations etc. The renter must always be ready to manoeuvre. The tenant must be of legal age. Children and young people are under the responsibility of their parents/accompanying persons.

5. RENTAL BOAT

Fuel costs and firewood are included in the rental price. The rental boat is handed over in roadworthy condition. The lessee/driver undertakes to take care of the rental object.

6. ACCIDENT OBLIGATIONS

The lessee ensures that the lessor and the maritime police are informed immediately, also that a sketch of the accident is drawn up and that the names and addresses of the persons involved in the accident and witnesses are ascertained. Verbal or written promises to third parties regarding benefits to injured parties are not permitted and remain irrelevant for the landlord.

7. LIABILITY COMPREHENSIVE INSURANCE

In the event of damage, the lessee must pay a deductible of at least CHF 500. In addition, the renter/driver remains personally liable for all damage that is not covered by the liability and fully comprehensive insurance. The landlord completely rejects any responsibility and consequences of costs in the event of personal injury and negligent behavior. The users of the rental boats are responsible for their own accident/liability insurance.

8. DAMAGE TO RENTAL BOAT

The lessee/driver is liable for any damage with a contribution of at least CHF 500, as a deductible. In the case of gross negligence, which is not covered by the insurance, the renter is fully liable for the entire damage.

9. REPAIRS

The tenant is obliged to check the rental property before the start of the rental period. In the event of silence, it is assumed that the rental property is in proper condition when it is handed over. For damage that occurs during the rental period, the renter is liable as described in points 7 and 8. All repairs must always be carried out by a workshop designated by the lessor. The lessee pays the lessor compensation in the amount of the loss of operation for the duration of a repair.


10. OWNER'S LIABILITY

The organizer rejects any liability, regardless of its legal basis, as well as claims for damages against Captain's Cove Boatrental GmbH and any auxiliary persons. The lessor is not liable for any damage that the lessee may incur as a result of any defect occurring in the rental property that prevents further travel, loss of time or other consequential damage.

11. PERFORMANCE OF CONTRACT

In the event that the rental object cannot be made ready to drive between the conclusion of the contract and the start of the rental, the lessor has the right to withdraw from the contract without any compensation.

12. WEATHER DEPENDENCE

In the event of uncertain weather conditions, the landlord reserves the right to postpone the booked activity to an alternative date requested by the tenant. In addition, the tenant can withdraw from his booked appointment and will receive a voucher worth the booked activity. In the event of a storm warning, the lessee is obliged to return to the port immediately.


13. HEALTH RISKS

Good health is a prerequisite for all activities. The participant undertakes to inform the organizer of any health problems. Participation in an activity under the influence of drugs, alcohol, psychotropic drugs or the like is not permitted. The landlord has sufficiently pointed out that swimming in the lake is at your own risk. The landlord points out that you have to use the bathing ladder and never jump directly into the lake.

14. LOSS OF PROPERTY

In the event of loss of the landlord's property, compensation equal to the purchase price will be charged. The tenant is not liable for left behind/lost property.

​

15. SUPPLEMENTARY PROVISIONS

In addition to these provisions, the Swiss Code of Obligations applies.

​

16. JURISDICTION
Interlaken is agreed as the exclusive place of jurisdiction for any disputes arising from this contract.
